In a Texas court, President-elect Donald Trump has reportedly now submitted an amicus brief that urges a federal judge to immediately halt any ongoing sale of border-barrier materials until an investigation into the Biden administration’s actions regarding the border wall is finalized.
The brief, authored by attorney John Sauer, who is expected to serve as Trump’s solicitor general during his second term, references a video report that depicts the Biden administration transporting substantial quantities of border wall material from the southern border for auction to private parties.
“The outgoing Biden Administration’s reported ‘fire sales’ of border-wall materials to private parties raise grave concerns about the legality of Defendants’ conduct and their compliance with this Court’s permanent injunction in this case. The Court should order an immediate stop of all such sales and perform a searching examination of the Government’s conduct—by ordering formal discovery if necessary—to ensure compliance with the Constitution, the law, and the Court’s orders.” the brief, which was obtained originally by The Daily Wire, argues.
The report discovered that private contractors were transporting the material to an auction site, where bidding for entire segments of unconstructed wall began at a mere $5.
The amicus brief, which was submitted in the Southern District of Texas, pertains to lawsuits initiated by Missouri and Texas against the Biden administration concerning the sale of wall material.
The brief also points to the Department of Government Efficiency, or DOGE, which was established by Trump in order to eliminate waste, fraud, and abuse.
Sen. Eric Schmitt (R-MO) conducted an inquiry that revealed that the Biden administration is only recovering 0.02% of the initial cost of the materials in its sale.
The brief also contends that the Biden administration’s defense of the sale, which is that a provision in the National Defense Authorization Act passed in 2023 authorizes the sale, is incorrect.
