Ted Cruz Claims that Daniel Penny Should Sue Manhattan DA for Malicious Prosecution

After Daniel Penny, a Marine veteran, was reportedly found not guilty of homicide in the New York City subway trial on Monday, Senator Ted Cruz, a Republican from Texas, stated that he should file a lawsuit against Manhattan District Attorney Alvin Bragg for “malicious prosecution.”

“Alvin Bragg is an absolute catastrophe. First, he indicted Donald Trump in a partisan case, and then he indicted Daniel Penny for saving the lives of other subway passengers from a deranged lunatic threatening to kill everyone,” Cruz said.

“Penny should sue Bragg for malicious prosecution and hold this rogue Soros prosecutor accountable,” he added.

Penny, who was 26 years old at the time, was found not guilty of a criminally negligent homicide allegation in the death of Jordan Neely, a homeless man who was 30 years old.

Neely had been yelling at and assailing people in a subway vehicle prior to Penny placing him in a chokehold in May of 2023.

Following the occurrence, the veteran was taken into jail and arrested; however, he was eventually freed after being questioned following the incident.

In the month of June 2023, a grand jury decided to indict Penny, which was one month after the death of Neely. He entered a Not Guilty plea.

Andre Zachary, Neely’s father, has officially filed a civil lawsuit against Penny, accusing the Marine veteran of violence, assault, and carelessness in relation to Neely’s death

The lawsuit was filed last Thursday. The lawsuit was submitted to the Supreme Court of New York.
