According to a news release, a judge in the Southern District of Florida dismissed a case against Republican Florida Governor Ron DeSantis about a statute that prohibits biological males from participating in women’s sports.
The Human Rights Campaign (HRC) contested DeSantis’ signing of the Fairness in Women’s Sports Act in June 2021 on the grounds that it violated Title IX of the Education Amendments and the Fourteenth Amendment to the United States Constitution.
The case was dismissed on Monday by former President Donald Trump’s appointee, United States District Judge Roy K. Altman, who stated that the case “doesn’t violate Title IX and does not lawfully denigrate transgender persons because of their “gender identification.”
Over the past few years, there have been some high-profile cases of men competing in women’s sports. Despite being ranked #462 as a male swimmer, Lia Thomas participated in NCAA women’s swimming and won multiple races.
In March, Tiffany Thomas, a 46-year-old male who identifies as transgender, defeated female competitors ranging in age from 24-32 in an amateur female cycling competition held in New York City.
For the 5k, Soren Stark-Chessa in Maine moved from the boys to the girls division, placing fourth in the girls’ division after starting 172nd in the boys’ division.
This year, a number of Republican governors passed legislation banning men from participating in women’s sports.
In June, Republican Texas Governor Greg Abbott approved legislation banning men from participating against women in collegiate athletics.
In April, Republican governor of North Dakota Doug Burgum signed two measures prohibiting male athletes from participating in female sports at the K–12 and university levels.
